1. Service Description

Diggy Party is an online booking platform operated by SC Nextera Concept SRL ("we", "us", "the Operator") that allows customers to reserve time slots at our children's playground facility. We offer two types of bookings: Event bookings (private 3-hour slots) and Open Session bookings (shared 2-hour sessions).

2. Booking and Payment Conditions

By completing a booking through our platform, you agree to the following conditions:

  • Event bookings require an advance payment to secure the reservation. The advance amount is displayed during the booking process and is charged via Netopia MobilPay at the time of booking.
  • For Event bookings, the remaining balance (total price minus advance) is due and payable exclusively online, via a payment link we send you by email on the day of the event or the day before.
  • Open Session bookings require full payment at the time of booking via Netopia MobilPay.
  • A booking is confirmed only after successful payment processing. You will receive a confirmation email with a QR code that serves as your entry ticket.

3. Delivery and Provision of Service

Diggy Party provides booking access to our children's playground facility. As this is a service booked online, delivery takes place as follows:

  • Your booking confirmation and entry QR code are delivered electronically, by email, immediately after your payment is successfully processed — normally within a few minutes.
  • The booked service itself is provided on-site at our playground facility (Strada Mărgelelor nr. 16, Bragadiru, Ilfov) on the date and time slot you selected during booking.
  • If you do not receive the confirmation email within 30 minutes, please check your spam folder and then contact us at contact@diggyparty.ro so we can resend it.

4. Cancellation and Refund Policy

Cancellation rules differ by booking type:

Event Bookings

You may cancel or reschedule an Event booking using the cancellation link provided in your confirmation email, up to 5 days before the event date. Within 5 days of the event, the booking can no longer be cancelled or rescheduled online and the advance is non-refundable. When cancelling before the deadline, you have two options:

  • Cancel and forfeit the advance — your booking is cancelled and the advance payment is not refunded
  • Cancel and reschedule — your booking is moved to a new available date and the advance payment is transferred to the new booking

Open Session Bookings

Open Session bookings are non-cancellable and non-refundable. By completing an Open Session booking, you acknowledge that no refund will be provided.

5. QR Code Validity

Each confirmed booking receives a unique QR code via email. The QR code can be used for check-in at the venue starting 2 hours before the booked time slot begins and remains valid until the slot ends. QR codes that have expired, have already been scanned, or belong to a cancelled booking cannot be used for entry.

6. Liability Limitations

The Operator shall not be liable for:

  • Inability to process bookings due to technical failures of third-party payment processors (Netopia)
  • Email delivery failures caused by third-party email service providers
  • Loss of booking data due to circumstances beyond our reasonable control

Parents or legal guardians are responsible for the supervision of children at all times during their visit to the playground facility.

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Romania. Any disputes arising from or related to these terms shall be settled amicably or, failing that, by the competent courts of București / Ilfov.

8. Changes to These Terms

We reserve the right to update these Terms of Service at any time. The "Last updated" date at the top of this page indicates when the terms were last revised. Continued use of the platform after changes constitutes acceptance of the revised terms.

Terms & Conditions — Open Play Sessions

The following specific rules apply to open play sessions held at the Diggy Party venue and supplement the general booking terms above.

1. Access and supervision

Open play sessions are intended for children aged 2 to 4 years. The recommended age range may differ for specific sessions and is indicated for each session at the time of booking. Access to the play space is granted exclusively on the basis of a valid ticket for the relevant session. Each child must be accompanied for the entire duration of the session by a parent or an adult legal guardian, who takes full responsibility for supervising the child and ensuring their safety. The Operator does not provide a supervision service and cannot replace the parent or accompanying adult.

2. Space usage rules

The play space, equipment, and toys may be used only for their intended purpose. Damaging, moving, or removing equipment from the play space is forbidden. Access to areas reserved for staff or marked as off-limits is strictly forbidden. Food and drinks may be consumed only in the designated areas. The parent or accompanying adult is responsible for compliance with the rules posted at the venue.

3. Sand zone rules

The sand zone is a central element of the Diggy Party concept. Entry into the sand zone requires removing street footwear; anti-slip socks are recommended. Throwing sand at other children, at the walls, or outside the marked area is not permitted. It is forbidden to bring into the sand zone any sharp, fragile, or electronic objects, or any food or drinks. Children must follow staff instructions regarding the use of the tools and equipment specific to this zone.

4. Electric equipment rules

The venue provides construction-site-style electric equipment (excavators, dump trucks, and similar) intended exclusively for children whose age and height match the specifications of each unit. The use of this equipment is permitted only under the direct supervision of the parent or accompanying adult and in accordance with staff instructions. It is forbidden to exceed the equipment's seating capacity, to use it for deliberate collisions, or to engage in uncontrolled racing. The Operator reserves the right to suspend access to the equipment if the rules are not followed.

5. Health and safety

Access to the play space is permitted only to children who, at the moment of entry, are in good health and do not show visible signs of a contagious illness (fever, persistent cough, skin rashes, conjunctivitis, and the like). Parents are kindly requested not to bring into the play space children with open wounds or conditions that could be worsened by play. Staff reserve the right to refuse entry, in the interest of the safety of all children present.

6. Assumption of risk

Play at the Diggy Party venue involves risks inherent to physical and recreational activities for children (slipping, falling, knocks, minor scratches, and the like). By purchasing a ticket, the customer acknowledges and accepts these risks and understands that the Operator has taken reasonable measures to mitigate them but cannot eliminate them entirely. The parent or accompanying adult is responsible for assessing the child's ability to participate in the activities specific to the play space.

7. Programme and access

The schedule of open play sessions is posted at the venue and on the Diggy Party website. A session lasts 2 hours. Entry to the play space is permitted no earlier than 5 minutes before the session begins. At the end of the session, children and their adults are kindly requested to vacate the space so the next session can be prepared. The Operator reserves the right to change the schedule or cancel a session for justified reasons, with prior notice to customers.

8. Limitation of liability

The Operator is not liable for personal belongings left in the play space or in the changing areas. The Operator is not liable for accidents or damage caused by the failure of customers or accompanying adults to comply with the rules, nor for those resulting from the negligence of the parent or accompanying adult in fulfilling their supervision obligation. The Operator's liability is limited to cases of proven personal fault and, in any event, to the value of the ticket paid.

9. Photo/video and GDPR

The Operator may take photographs and video recordings in the play space for the purpose of promoting its services. The parent or accompanying adult is informed of this and may object to the appearance of their child in published materials by sending a notification to the Diggy Party contact address. Personal data is processed in accordance with the Privacy Policy available on the website and with Regulation (EU) 2016/679 (GDPR).

10. Acceptance of terms

By purchasing a ticket for an open play session and by entering the Diggy Party venue, the customer confirms that they have read, understood, and fully accepted these terms and conditions. Failure to comply with the rules may result in termination of access without refund.

Terms & Conditions — Private Parties and Venue Rental

The following specific rules apply to private parties and the exclusive rental of the Diggy Party venue and supplement the general booking terms above.

1. Object of the service

The Operator, through Diggy Party, provides the customer with exclusive rental of the play space for the purpose of hosting a private party, for the duration and under the conditions agreed at the time of booking. The service includes access to the construction-themed area, the sand zone, the electric equipment, and the play equipment available, within the declared capacity.

2. Rental duration and access

The standard rental duration is 3 hours. The number of participating children is the number agreed at booking; exceeding this number without the Operator's prior consent attracts additional fees in accordance with the posted tariff. The customer and their guests may enter the venue no earlier than 15 minutes before the start of the event and must vacate the space no later than the end time stated in the booking confirmation.

3. Child supervision

Throughout the entire duration of the party, each child must be supervised by a parent or an adult legal guardian. The Operator does not provide a supervision service and is not responsible for any lack of supervision on the part of the customer or their guests. The customer confirms that they have informed their guests of this obligation.

4. Use of space and equipment

The space, equipment, and toys may be used only for their intended purpose and in accordance with staff instructions. Moving, damaging, or removing equipment from the play space is forbidden. Access to areas reserved for staff or marked as off-limits is strictly forbidden. Decorations and furniture brought in by the customer must be agreed in advance with the Operator.

The electric equipment may be used only by children whose age and height match the specifications of each unit, under the direct supervision of the parent or accompanying adult. It is forbidden to use the equipment for deliberate collisions, uncontrolled racing, or for carrying objects or persons beyond its capacity. The Operator reserves the right to suspend access to the equipment if the rules are not followed.

7. Health and safety

Access to the play space is permitted only to children who, at the moment of entry, are in good health and do not show visible signs of a contagious illness. The customer undertakes to inform their guests of this requirement. Staff may refuse entry, in the interest of the safety of all children present.

8. Assumption of risk

The activities carried out at the Diggy Party venue involve risks inherent to physical and recreational activities for children. The customer and their guests acknowledge and accept these risks and understand that the Operator has taken reasonable safety measures but cannot eliminate the risks entirely. Parents and accompanying adults are responsible for assessing the child's ability to participate in the activities.

9. Liability for damages

The customer is fully liable for any damage to equipment, furniture, or the premises caused by them or by their guests, including the participating children. The amount of the damage is determined on the basis of the replacement or repair cost and is payable within a maximum of 7 days from notification. In the case of major damage, the Operator reserves the right to seek remedy through the competent courts.

10. Cleanliness and conduct

The customer and their guests undertake to keep the rented space clean and to comply with the conduct rules posted at the venue. Alcohol consumption is permitted only by adults and only in the designated areas. Smoking is forbidden throughout the entire indoor venue. The Operator reserves the right to terminate the event early in case of behaviour that endangers safety or causes damage to the venue, without refund.

11. Limitation of liability

The Operator is not liable for personal belongings left in the play space or in the changing areas, for losses or damage arising from the negligence of the customer or their guests, nor for unforeseen events outside its reasonable control. The Operator's liability is limited to cases of proven personal fault.

12. Photo/video and GDPR

The Operator may take photographs and video recordings in the play space for the purpose of promoting its services. The customer is informed of this and may object to the appearance of children in published materials. Personal data is processed in accordance with the Privacy Policy available on the website and with Regulation (EU) 2016/679 (GDPR).

13. Acceptance of terms

By paying the advance or the full booking amount and by holding the party at the Diggy Party venue, the customer confirms that they have read, understood, and fully accepted these terms and conditions and that they have informed their guests of the applicable rules.
